Breakdown of Criminal Assault in Missouri:

First Degree Assault

  • Committed when someone attempts to Kill or attempts to cause serious physical injury to another person.
  • Class A Felony if serious injury results. Class A Felony carries a range of punishment from 10-30 years or life in prison.
  • Class B Felony if victim is not seriously injured. Class B Felony carries a range of punishment from 5-15 years in prison.

Second Degree Assault

  • Committed when someone attempts to kill another person under the influence of sudden passion arising out of adequate cause; attempts to injure another person with a deadly weapon, recklessly causes serious injury to another person; injures another person while operating a motor vehicle under the influence of drugs or alcohol; or injures another person by recklessly shooting a gun.
  • Class C Felony – Range of punishment is up to 7 years in prison.

Third Degree Assault

  • Can be committed as simply as “purposely putting another person in apprehension of immediate physical injury”
  • Classification ranges from a Class C Misdemeanor to a Class D Felony based on prior offenses and severity of the current offense alleged.
